Service Tax Clearance Certificate

navin sinha

In most of the tender notice , the parties are asked to get Service Tax Clearance certificate from the department and the department do not issue any such certificates

Service Tax Clearance certificate: no statutory certificate exists; provide registration copy or self declaration of compliance instead. No statutory Service Tax Clearance Certificate exists and the department has no authority to issue one; tenderers should provide a copy of their Service Tax Registration and may attach a company self certification that, to the best of their knowledge and records, service tax liabilities and return filing obligations have been complied with. Tendering authorities commonly accept the registration copy or a self declaration; requests for an Income Tax clearance or a department certified copy reflect tender requirements but do not create a statutory departmental service tax clearance certificate. Sir,

The department will not issue any such certificate and it has authority to do so. You may enclosed xerox copy of your service tax registration certificate along with you tender application.

Dear Navin,

There is no such certificate exist in the Finance Act, 1994. However, you may issue a certificate on your company's letter head that to the best of you knowledge, as per best of your knowledge, believes, records and returns, have paid the service tax liability within prescribed time limit and also adhered with the compliance in this regard, by attaching the self certified Service Tax Registration Certificate.

Sir,

In my previous reply certain typographical errors had crept in The corrected reply is as follows: - The department will not issue any such certificate and it has no authority to do so. I feel that parties want to ensure that you are paying service tax on the service you are providing under the tender. You may enclose a xerox copy of your service tax registration certificate along with your tender application.

Sir,

Generally Income Tax Clearance certificate is required to be submitted.

For service tax purpose, only a copy of Service Tax Registration Number is to be provided.
