kanth kakarla

Dear Sir/Madam,

We are a manufacturing company we are supplying to 100% EOU one my customer is telling that he will provide us CT3 form after supplying material my query is that it is possible that without CT3 form we can made supplies is their any possibility for that. if it possible let me know the notification or amendments etc.., Kindly help me with your valuable suggestions.

CT 3 certificate requirement: goods cleared without the certificate must be cleared on payment of duty, with EOU duty credit. A CT 3 certificate is required to clear manufactured goods without payment of duty; if the supplier does not possess the CT 3 certificate at the time of clearance, the goods must be cleared on payment of duty, and the 100% EOU recipient may take credit of the duty paid by the supplier, consistent with the conditions of the applicable notification. Dear Mr. Kakaria,

CT-3 certificate is required to clear the manufactured goods without payment of duty. If you are in possession of CT-3 certificate at the time of clearing the goods, you have to pay duty on such goods. The 100% EOU can take credit of duty paid by you.

Dear Mr. Kakarla,

I apologize for typing error crept in my previous reply. first I have typed your name wrongly. Secondly, in the second sentence of my reply please read "If you are not in" instead " If you are in".

Sir,

Yes, you may also remove the goods on payment of duty, as explained above.

You may refer Condition 05 of Notification No. 22/2003 dated 31.03.2003.

Still, If you do not follow the said condition, then please do let me know for necessary explanation.
