REQUIREMENT OF FORM 15CB

Dear Sir,

Please let me know applicability of Form 15CB taken from Chartered Accountant. whether this certificate required only in case of foreign remittance related to income chargeable to tax in India  or this is applicable for all foreign remittances including import of goods.

Please let me know whether Form CA to be filled online in case of foreign remittances which covered under chargeable to tax in India or this to be filled up in all foreign remittances.

Please clarify the same keeping in view that we are company registered in India and we have to make foreign remittance to foreign company.

In my personal view, only those foreign remittances are exempt which have been specifically provided under law I.e. 28 payments, which does not include import of goods.

That means the CA issuing form 15CB has to determine whether the foreign remittance is taxable in India including import of goods.

Please confirm also for the applicability of Form 15CA which need to submit on income tax website. Whether form 15CA to be filled up only in case of foreign remittances chargeable to tax on india or for all foreign remittances including remittances for import of goods after getting Form 15CB from Chartered accountant.
