Vaidyanathan Venkat Raman

Sir,

Kindly let me what is the court fee amount that need to be affixed along with Appeal and stay application before Commissioner of Central Excise (Appeals). Kindly let me know under the which rule/act, the fee amount is mentioned.

Court Fee for Appeal: 50 Paisa Stamp Required, Missing Stamp is Curable, No Extra Fee for Application A query was raised regarding the court fee required for filing an appeal and stay application before the Commissioner of Central Excise (Appeals). The response indicated that a court fee stamp of 50 paisa must be affixed to the appeal and copy of the order. However, if the stamp is not affixed, it is a curable defect and cannot lead to the dismissal of the appeal. No additional fee is required for the application itself. (AI Summary)

Affixing of court fee stamp, of 50 paisa, to appeal and copy of order is required while filing of appeal before Commissioner (Appeals). If it is not affixed, it is curable and appeal cannot be dismissed on this ground.

No fee is payable along with such an application.
