DGFT denies Duty Drawback claim for deemed exports due to inclusion of CVD; CENVAT credit impacts claim approval. A user inquired about claiming Countervailing Duty (CVD) in a Duty Drawback claim submitted to the Directorate General of Foreign Trade (DGFT) for deemed exports. The DGFT rejected their claim due to the inclusion of CVD. A response from an indirect tax consultant clarified that if CVD is claimed as CENVAT credit while availing Duty Drawback under the All Industry Rate, the authority may reject or reduce the claim based on the extent of CENVAT credit availed.
