AUTO PART (LOOSE)

DEEPAK SHARMA

We are registered with Central Excise Department, there is our brand and we sale goods in packed form and reveal MRP on products and discharging excise duty on MRP. sometimes our buyer order us that please supply the goods without packing or marks on products, and discharge excise duty on transactio value

Is it  correct that, same products we are saling in packed form and discharging excise duty on MRP and same products we sale in loose without any packing or marks on products and paying excise duty on transaction value. please clarify the matter.

Company Warned: Selling Products in Packed and Loose Form May Violate Legal Metrology Act, Risking Penalties A company registered with the Central Excise Department inquired about the legality of selling the same products in both packed form with MRP and loose form without packing, paying excise duty on MRP for the former and transaction value for the latter. The response warned that this practice could violate the Legal Metrology Act, potentially leading to penal actions from the Legal Metrology and Central Excise Departments. It advised the company to comply with appropriate excise duty regulations to avoid short-term gains that could result in long-term losses. (AI Summary)
