time limit for taking Input Service Tax Credit

RAMNIRANJAN KANDOI

Kindly give case laws for taking Service tax credit even after one or two years as there is no time-limit for taking Credit

Input service tax credit entitlement depends on ST-3 recording and revised return procedure for later utilization. Whether input service tax credit can be taken after the quarter of invoice receipt depends on recording and procedure: input service tax credit should be shown in the ST-3 return for the quarter of invoice receipt, utilization against liability may occur later, and if omitted the taxpayer should file a revised return to claim the credit; contributors assert no fixed statutory time bar where procedural correction is made. the input credit to be shown in the ST 3 returns in the quarter of receipt of invoice from the service provider. later you can claim the ST input against your liability at any time. if you mistaken to claim the ST input in the relevant quarterly returns file revised return other wise you can not claim ST input.
