Excess service tax payments: avail cenvat credit if refunded by credit note, or set off against future liabilities. As per my view, if the service tax paid in excess has been received to you from your customer and you have refunded to your customer by way of issuing credit note, you make take cenvat credit of service tax paid in excess. Another option is also available, set off the excess paid service tax towards your upcoming service tax liability.
