Rebate Claim under Rule 18 C.E.

sukhvinder singh

Respected All,

I m working in a manufacturing company & i m clear my export under rebate claim. Now my question is that what is procedure when we not get the proof of export within 6 month and my CHA give me information the he will provide me the document ( BRC ) with in 2 & 3 weeks after 6 month.

 Then what can we do.

Please provide me suitable information in this regards

Thanks & Regards

Rebate claim period: one year to file with extensions for delayed proof of export; seek AC/DC approval promptly. Where proof of export is delayed, the procedural remedy is to apply to the jurisdictional AC/DC for extension of time with a genuine explanation; the Central Excise Manual (Annexure 19) offers procedural guidance and exporters are commonly advised that the rebate claim window extends up to one year, subject to documented extension for submission of proof of export (BRC/POE). Dear Mr.Sukhvinder,

Go through the Annexure 19 given in the Central Excise Manual to get the answer.

You may have to seek the extension of time from the AC/DC in this regard by submitting the genuin reason for the same.

Dear Sir, If you are making export under rebate, then you have one year time to claim rebate of export and not six months.  If you do not get documents in time then  you can take extension for submission of POE from the jurisdictional AC/DC.
