Sir,

We applied on line ST-1 in 2010 and  filed online ST-3 from time to time as required by deptt  Our ST-3 has been rejected by the department on the ground that ST-2 has not been issued due to non submission of documents ( hard copy) for issuing of ST-2

Kindly suggest

1. As we applied on line ST-1 for registration, Is it mandatory to file application in hard copy with department for regn & issuance of ST-2. Can it not be considered as deemed to registered if department not returned the ST-1 with in 7 days from the date of filed on line by us.

2.Suppose we forgate to file hard copy of docts,,  we has been filied ST-3 on line regularly and deptt.rejected the same, What is the remidy for us to regularise the cenvat availed & distributed by us and for obtain ST-2 form.

Kindly suggest with Rule / decision of cases.

Please clarify your fact in pursuant to your query.   

When the Department had rejected your ST-2?

Whether you were regular in deposition of  service tax and filing of returns?

If you were filing online return since 2010 and these are being rejected, then, what corrective action you had taken?

Dear Sir,

1.When the Department had rejected your ST-2 ? :- As per deptt.,  ST-2 has not been issued due to non submission of hard copies of docts tin deptt. hence no matter of rejection of ST-2 by deptt.

2.Whether you were regular in deposition of  service tax and filing of returns?:- Yes, We were paying tax online by using ST regn.No. of our Branch office, ST-3 filed with regularly but rejected online with a reason that  ST-2 not yet issued..

3. If you were filing online return since 2010 and these are being rejected, then, what corrective action you had taken? :- Earlier we have not seen the online status, this time when we click for status, we found that all ST-3 have been rejected, we approached to central excise deptt, he clarify that ST-2 has not been issued due to non submission of hard copies of docts for registration.

Kindly have a meeting with the Jurisdictional Commissioner of C.E./S.T. and get the registration regularized from him. He is the person who can help you out in this matter.
