Cenvat Credit

Ranbir Singh

Sir, can we take cenvat credit on proforma Invoice.?

Cenvat Credit Ineligibility on Proforma Invoices Clarified; Rule 11 of Central Excise Rule 2002 Cited A query was raised regarding the eligibility to take Cenvat credit on a proforma invoice. Four responses clarified that Cenvat credit cannot be claimed on proforma invoices. It was explained that proforma invoices are not recognized under Rule 11 of the Central Excise Rule, 2002, which requires a formal invoice for Cenvat credit eligibility. Proforma invoices are used to estimate the value of goods and do not involve excise duty payment by the seller, making them invalid for Cenvat credit purposes. (AI Summary)

Proforma Invoice is issued to quanitify the approximate value of the goods about to be invoiced in near future and the same is not valid a document for taking Cenvat Credit. Further, the seller who issues the proforma invoice will not make any payment of Excise duty based on the proforma invoice.
