Court Compliance Process for Pre-Deposit Orders u/s 35-F of Central Excise Act to Prevent Delays.
The circular outlines a procedure to ensure compliance with pre-deposit orders under Section 35-F of the Central Excise Act, 1944, and related provisions in the Customs and Service Tax laws. To prevent court delays, the Registry must verify compliance before court proceedings. A compliance report date is set four weeks after the deposit deadline. The Registrar will verify compliance within eight days post-deadline in a hearing with the appellant's and Department's representatives. A report is then submitted to the court. This procedure applies to all relevant benches and takes effect from February 1, 2010.
