Service tax payments by cheque not complete until encashment; ensure clearance by due date to avoid penalties.
The Central Board of Excise & Customs clarified that service tax payments made by cheque are not considered discharged until the cheque is encashed and the funds are credited to the Government of India's account. This is in accordance with RBI instructions, which state that funds remain in the payer's account until cheque clearance. Payments by cash or demand draft receive immediate credit. Therefore, service tax payments by cheque must be cleared by the due date to avoid penalties. Trade associations are urged to inform their members, and a previous trade notice on this matter has been withdrawn.
