<h1>Supreme Court Rules DRI Lacks Authority for SCNs u/s 28(4) of Customs Act; Proceedings Invalidated.</h1> A Show Cause Notice (SCN) issued by the Directorate of Revenue Intelligence (DRI) against Anil Aggarwal and 11 others is to remain pending following a Supreme Court judgment. The Court ruled that the Additional Director General of DRI is not authorized to issue SCNs under Section 28(4) of the Customs Act, 1962, rendering the proceedings invalid. The Central Board of Indirect Taxes and Customs is examining the judgment's implications. Until further notice, new SCNs under Section 28 should be issued by jurisdictional Commissionerates. Any difficulties should be reported to the Board.
