Supreme Court Rules DGFT Notifications on Target Plus Scheme 2005-2006 Cannot Be Applied Retroactively; New Amendments Issued.
The Supreme Court's judgment on 27.10.2015 in the case between DGFT and Kanak Exports ruled that certain DGFT notifications related to the Target Plus Scheme (TPS) of 2005-2006 cannot be applied retrospectively. The government has decided to implement this judgment. Consequently, DGFT issued a new notification to amend previous policies and rescind certain notifications, aligning their effective dates with the issuance date rather than retroactively. Additionally, Zonal Committees have been established to scrutinize claims to prevent misuse of the scheme, with TPS scrips to be issued post-scrutiny for exports from 2005-2006.
