New Guidelines for Re-Testing Imported Goods Samples Under TFA: Importers Can Request Within 10 Days.
The circular outlines guidelines for re-testing samples of imported goods under the Trade Facilitation Agreement (TFA) to ensure uniformity in customs procedures. If initial test results are adverse, importers can request a re-test within ten days. The Additional/Joint Commissioner of Customs must specify the laboratory for re-testing. Re-tests should use remnants of original samples or representative samples in Customs custody. The competent authority will consider re-test results without prejudice to the initial test. Re-testing is generally a facilitation measure, but may be denied on reasonable grounds. The procedure applies similarly if initiated by the department.
