of <h1>Clarification Issued: New 100% EOU Can Sell in DTA Despite Previous Circular's Limitations if Conditions Met.</h1> The circular addresses the refusal by Central Excise authorities in Bhiwadi Division to honor the Development Commissioner's permission for a 100% Export Oriented Unit (EOU) to sell in the Domestic Tariff Area (DTA). The EOU, based on physical exports worth Rs. 1.42 crores from April to September 2000, received permission to sell goods worth Rs. 72 lakhs in the DTA. The refusal was based on a previous circular limiting DTA sales to 50% of the previous year's exports, but the unit was newly established in March 1999. The circular clarifies that the permission is valid if other conditions are met, and the rejection by the Excise authorities was incorrect.
