The appeals involved the Central Excise Department and the Indian Oil Corporation (I.O.C.) regarding the removal of consignments without payment of Central Excise Duty. The appeals were allowed, the orders of the Collector (Appeals) were set aside, and the matters were remanded for further consideration in line with the Tribunal's observations.In conclusion, the Tribunal emphasized the need to properly assess losses and gains during transit and to allow for setting off gains against losses before demanding duty.
