The A.O. admitted that the funds given by the lender company were from its own sources, as evidenced by the balance sheet showing a share premium reserve in the immediately preceding year. The CIT(A) found that the identity, capacity, and creditworthiness of the lender company, as well as the genuineness of the transaction, were established based on the documentary evidence provided.

                          The CIT(A) relied on various judicial pronouncements, including the judgments of the Hon'ble Supreme Court in the case of CIT vs. Odeon Builders Pvt. Ltd. and the Hon'ble Delhi High Court in the case of CIT vs. Vrindavan Farms (P) Ltd., to conclude that the addition made by the A.O. could not be sustained. The CIT(A) directed the deletion of the addition of Rs. 3,60,00,000/-.
