The assessee furnished Form 26A, showing that the recipients had included the interest in their income and paid the necessary taxes. However, the AO disallowed the interest payment under Section 40(a)(ia) for non-deduction of TDS. The CIT(A) confirmed this disallowance. The Tribunal noted that the second proviso to Section 40(a)(ia), inserted by the Finance Act, 2012, allows for deduction if the recipient has included the payment in their income and paid the taxes.
