Prima facie, there appears to be no application of mind afresh by the ITAT particularly in the context of the specific directions issued by this court in its earlier order. The Delhi High Court judgment involved a case where the ITAT's order was challenged for not applying fresh consideration as directed by the court in an earlier order. The case was adjourned for further arguments to be heard on May 17, 2017.
