Issues: (i) Whether the conviction for non-compoundable offences arising out of matrimonial discord could be quashed on the basis of compromise between the spouses. (ii) Whether, in the facts of the case, the substantive sentence could be reduced to the sentence already undergone.
Issue (i): Whether the conviction for non-compoundable offences arising out of matrimonial discord could be quashed on the basis of compromise between the spouses.
Analysis: Offences under Section 498A of the Indian Penal Code, 1860 and Section 4 of the Dowry Prohibition Act, 1961 are non-compoundable and cannot be compounded in view of Section 320 of the Code of Criminal Procedure, 1973. A compromise between the husband and wife may justify quashing of proceedings in appropriate cases to prevent abuse of process or to secure the ends of justice, but that principle does not extend to setting aside an already recorded conviction for such non-compoundable offences.
Conclusion: The conviction could not be quashed on the basis of compromise and was maintained.
Issue (ii): Whether, in the facts of the case, the substantive sentence could be reduced to the sentence already undergone.
Analysis: Section 498A of the Indian Penal Code, 1860 does not prescribe a minimum sentence, and the proviso to Section 4 of the Dowry Prohibition Act, 1961 permits imposition of a term below the statutory minimum for adequate or special reasons. In view of the genuine settlement, the payment of compensation, the passage of time, and the circumstances of the case, reduction of sentence was found justified.
Conclusion: The sentence was reduced to the period already undergone, subject to payment of compensation.
Final Conclusion: The appeal succeeded only to the extent of sentence reduction, while the conviction remained intact.
Ratio Decidendi: A compromise in a matrimonial dispute cannot by itself quash a conviction for non-compoundable offences, but it may justify reduction of sentence where the statute permits a lesser term and the circumstances warrant such relief.
