Non appearance by assessee - assessee is not interested in prosecuting the appeal - HELD THAT:- Despite noting of the hearing, when the appeal was taken up for hearing on 30.01.2017, none appeared on behalf of the assessee or any adjournment request has been filed by the assessee. Hence, it is inferred that the assessee is not interested in prosecuting the appeal. Therefore, having regard to Rule 19(2) of ITAT Rules and following the decision in the case of Multiplan (India) Ltd. [1991 (5) TMI 120 - ITAT DELHI-D] and case of late Tukojirao Holkar [1996 (3) TMI 92 - MADHYA PRADESH HIGH COURT] the appeal of the assessee is dismissed for want of prosecution. - Decided against assessee. The appeal filed by the assessee against the Deputy Commissioner of Income Tax's order for the assessment year 2011-12 was dismissed by the Appellate Tribunal ITAT Chennai on 31st January 2017 due to lack of prosecution by the assessee.
