Issues: Whether the exporter was entitled to exemption from export duty under Notification No. 62/2007-Cus. on the basis of the re-test result showing Fe content below 62%, and whether remand was necessary.
Analysis: The re-test had been duly permitted and the result communicated by the customs authorities showed Fe content of 61.0% and 60.8% for the consignments. On that factual basis, the condition in the notification stood satisfied and the exporter became eligible for the exemption. As the decisive re-test result was already on record and no useful purpose would be served by sending the matter back, remand was declined.
Conclusion: The exporter was held entitled to the benefit of the exemption notification, the demand of differential duty was unsustainable, and the request for remand was rejected.
