Issues: Whether the impugned adjudication order was invalid for want of identification of the person who purportedly passed it, and whether the matter should be remanded for fresh adjudication with opportunity to place additional documents on record.
Analysis: The order did not disclose the name of the person who passed it either in the preamble, on the last page, or elsewhere. In the absence of such identification, the order was treated as not a valid order in law. Since relevant documents had subsequently been obtained and were sought to be relied upon, the assessee was to be given an adequate opportunity to produce them before the adjudicating authority.
Conclusion: The impugned order was set aside and the matter was remanded for passing a fresh order after granting the assessee an opportunity of hearing and to place the documents before the adjudicating authority.
