The tribunal examined whether the surrender was voluntary and whether the penalty was justifiable based on the quantum addition.It was emphasized that for penalty imposition, there must be conclusive evidence of concealment or furnishing of inaccurate particulars. The tribunal found that the Assessing Officer's reasoning was based on inferences rather than concrete evidence, such as cross-verification from third parties.
