Issues: Whether the impugned order should be set aside and the matter remanded for fresh adjudication after affording a reasonable opportunity of hearing, and in the light of the subsequent Larger Bench decision governing description, classification and valuation of the goods.
Analysis: The show cause notice had remained undelivered and no effective reply had been received, but the circumstances indicated that the appellants intended to contest the matter. In the interest of justice, one opportunity was considered necessary to enable the appellants to place their defence. The controversy regarding the description of the goods, their classification and the duty payable was also required to be reconsidered according to the ratio of the later Larger Bench decision, which had been rendered after the impugned order.
Conclusion: The impugned order was set aside and the matter was remanded to the adjudicating authority for fresh decision after granting a reasonable opportunity of hearing to both sides.
