In the circumstances the appeal is dismissed but without any order as to costs. The Supreme Court of India dismissed the appeal without costs, citing the law laid down in Pournami Oil Mills v. State of Kerala and affirming the ratio in Motilal Padampat Sugar Mills Company Limited v. State of Uttar Pradesh. The question raised in the appeal was concluded based on these precedents.
