Speakers Cannot Preside When Their Removal Is Being Debated: Constitutional Provisions Under Articles 180, 181 and 189
Article 181 of the Indian Constitution prohibits the Speaker or Deputy Speaker from presiding over Legislative Assembly sittings when a resolution for their removal is under consideration. During such proceedings, Article 180(2) provisions apply as if the officer were absent. The Speaker retains the right to participate in debates regarding their removal and may vote initially on such resolutions but cannot cast a deciding vote in case of a tie, despite Article 189 provisions.
