MGA prohibited activities restrict binding reinsurance, syndicate participation, delegation of authority, and joint employment arrangements. An MGA is prohibited from entering into binding re-insurance or retrocession contracts on behalf of the foreign insurer, participating in insurance or reinsurance syndicates, assigning the contract or further delegating underwriting or claims authority, and jointly employing an individual employed with the foreign insurer. The regulation defines the limits on the MGA's contractual, syndicate-related, delegation, and employment arrangements in relation to the foreign insurer.
