Misuse of social security benefits requires prior hearing before deprivation by notification. Misuse of a benefit under the Code or the rules may be determined on the recommendation of the authority, competent authority or Social Security Organisation, where the Central Government is satisfied that an establishment or other person has misused the benefit. The Central Government may then issue a notification depriving the establishment or person of that benefit for the period specified in the notification, but only after giving an opportunity of being heard.
