Contractual employee bonus liability shifts to the principal establishment when contractor default is verified and reported in writing. Where employees are engaged through a contractor and the contractor fails to pay bonus under section 26, the company, firm, association or other person referred to in the proviso to section 43 must pay the minimum bonus to those employees after receiving written information from the employees or a registered trade union and confirming the failure.
