Advance Rulings Board Processes Tax Applications; Rejections for Pending Issues or Tax Avoidance; Decisions in Six Months
Upon receiving an application, the Board for Advance Rulings forwards it to the Principal Commissioner or Commissioner to obtain relevant records. The Board may allow or reject the application based on its examination. Rejection occurs if the issue is pending before tax authorities, involves property valuation, or is designed to avoid tax, except in specific resident cases. Applicants must be heard before rejection, with reasons provided. Approved applications lead to a written advance ruling within six months. Applicants can request a hearing before the ruling. Copies of decisions are sent to the applicant and relevant tax authorities. An authorized representative can act on behalf of the applicant.
