<h1>Failure to File Notice Under Section 6(2) Can Lead to CCI Inquiry Under Section 20(1) on Competition Impact.</h1> Parties involved in a combination must file a notice under section 6(2) of the Act. If they fail to do so, the Competition Commission of India (CCI) can initiate an inquiry under section 20(1) to determine if the combination adversely affects competition in India. If the CCI decides to proceed with an inquiry, it will instruct the parties to submit a notice using Form I or Form II, as determined by the Commission, within 30 days of receiving communication from the CCI. This process is independent of any penalties or prosecutions that may follow under the Act.
