Confidentiality protections for leniency applicants preserved, with limited exceptions and conditional disclosure subject to Commission approval. Confidentiality is required for leniency applicants: the identity of the applicant and the information, documents and evidence furnished under the lesser penalty regulations must be treated as confidential, subject to exceptions where disclosure is required by law, the applicant consents, the applicant has publicly disclosed the information, or where the Director General, for recorded reasons and with prior Commission approval, discloses materials to a party for investigation. Submissions to the Commission are initially protected for fifteen days (or any extension), after which confidentiality of further submissions before the Director General is governed by regulation 35 of the General Regulations.
