<h1>Section 46 Amended: Cartel Members Can Get Lesser Penalties for Key Disclosures, Conditions Apply for Cooperation.</h1> Section 46 of the principal Act is replaced to allow the Commission to impose a lesser penalty on cartel members who make full, true, and vital disclosures about violations of section 3. Lesser penalties are not applicable if disclosures are made after an investigation report under section 26 is received, or if cooperation ceases before proceedings are complete. The Commission can revoke lesser penalties if conditions are breached or false evidence is provided. Applicants may withdraw their lesser penalty requests, and evidence submitted can be used by authorities, excluding admissions. Lesser penalties may also apply for disclosures about additional cartels.
