of <h1>Amendment to Section 452: No imprisonment for officers withholding property if company hasn't paid due welfare funds.</h1> Section 452 of the principal Act has been amended by the Companies (Amendment) Act, 2020, to include a proviso in sub-section (2). This proviso states that imprisonment for officers or employees for wrongful possession or withholding of a dwelling unit shall not be ordered if the court finds that the company has not paid the officer or employee any due amounts related to welfare funds, such as provident or pension funds, or compensation under the Workmen's Compensation Act, 1923, for death or disablement.
