Companies Act Section 16 Amended: Time Frame Reduced to 3 Months, New Name Assigned for Non-compliance.
Section 16 of the Companies Act has been amended by the Companies (Amendment) Act, 2020. The amendment changes the time frame in sub-section (1), clause (b), from 'six months' to 'three months.' Additionally, sub-section (3) has been replaced, stipulating that if a company fails to comply with directions under sub-section (1), the Central Government will assign a new name to the company. The Registrar will update the register and issue a new certificate of incorporation with the new name, although the company may later change its name following section 13 provisions.
