SEBI Can Ban Investment Advisers, Mandate Fee Refunds to Protect Investors Under July 2020 Amendments
The Securities and Exchange Board of India (SEBI) may, after reviewing an inspection report and providing a hearing opportunity to investment advisers or their representatives, issue directives to protect the securities market or investors. These directives may include prohibiting investment advisers and related individuals from offering advice for a set period, mandating the return of fees or commissions with interest to clients, or banning them from participating in or accessing the capital market for a specified duration. Amendments to these provisions were made effective through a notification in July 2020.
