Settlement application permits regulated persons to seek resolution subject to full disclosure, waivers and prescribed procedural compliance. A person facing specified proceedings may apply for settlement in the prescribed form with a non refundable fee and specified undertakings and waivers, making full and true disclosures; facts admitted or established in related proceedings are deemed admitted. One application must cover all proceedings from the same cause of action; incomplete or non conforming applications will be returned with a limited opportunity to revise. Applications by firms, associations or corporates must be executed by the person responsible for the business and bind the entity and any officer in default. Settlement of disclosure related defaults requires the required disclosure to have been made.
