SEBI Forms Advisory Committee with Judicial Member for Settlement Terms; Recommendations Prevail Without Consensus
The Securities and Exchange Board of India (SEBI) establishes a High Powered Advisory Committee to recommend terms of settlement. This committee includes a Judicial member, formerly a Supreme Court or High Court Judge, and three external experts in securities markets. Members serve a three-year term, extendable by two years. A quorum requires three members, and meetings can occur electronically. If a member recuses, the remaining members can make recommendations. In case of no consensus, the Judicial member's recommendation prevails. If the Judicial member recuses, the remaining members' recommendations go to the Panel of Whole Time Members. If most members recuse, a new committee may be formed.
