Individuals Can Settle Securities Board Proceedings Under Section 15JB; No Appeals Allowed Against Settlement Orders.
Section 15JB of the Securities and Exchange Board of India Act, 1992, allows individuals facing or potentially facing proceedings under specified sections to apply for a settlement with the Board. The Board may agree to a settlement based on the nature and impact of the defaults, following procedures outlined in the regulations. Settlements can include monetary payments or other terms, and no appeal is permitted against orders made under this section. Settlement amounts, excluding disgorgement and legal costs, are credited to the Consolidated Fund of India. This provision was amended in 2014 and 2018.
