Rules for Safeguard Measures Under India-Malaysia Agreement: Max Duration 4 Years, No Reapplication Within 1 Year
The India-Malaysia Comprehensive Economic Cooperation Agreement (Bilateral Safeguard Measures) Rules, 2017, outlines the duration of safeguard measures. The suspension of trade concessions or application of bilateral safeguards is limited to the necessary period to prevent or remedy serious injury, not exceeding two years initially. The Central Government may extend this period by up to two additional years based on recommendations, but the total duration cannot exceed four years. Measures terminate at the end of the transition period for the originating good. A safeguard measure cannot be reapplied to the same good within one year after the previous measure's expiry, and must be shorter than the previous duration.
