Indian Trusts Act Section 20 Amendment Expands Trustee Investment Powers by Broadening Permissible Securities Scope
Section 20 of the Indian Trusts Act, 1882, as amended by the Finance Act, 2017, modifies the investment powers of trustees. The amendment replaces the phrase 'invest the money in any of the securities or class of securities expressly authorised by the instrument of trust or' with 'make investments as expressly authorised by the instrument of trust or in any of the securities or class of securities.' Additionally, it removes the proviso phrase 'in any of the securities or class of securities mentioned above,' thereby broadening the scope of permissible investments for trustees.
