Foreign currency accounts abroad: who may maintain them, permissible uses, and repatriation and reporting obligations. Regulation 5 prescribes who may open and maintain foreign currency accounts abroad, the permissible purposes for such accounts, and associated conditions: authorised dealers and their branches for foreign exchange business; Indian entities for overseas offices/branches subject to remittance limits, closure and repatriation requirements and specific exceptions; exporters and exporters receiving advance receipts subject to export approval and repatriation timelines; Indian parties making overseas direct investment where host country rules require designated accounts subject to ODI eligibility, restricted use of funds, repatriation of returns, annual audited reporting and account closure on disinvestment.
