Amendment to Section 8 of Prevention of Money-Laundering Act: Special Court Can Restore Property to Good Faith Claimants.
Clause 173 of the Finance Bill, 2015 amends section 8 of the Prevention of Money-Laundering Act, 2002. It replaces 'Adjudicating Authority' with 'Special Court' in subsection (3), clause (b). Additionally, a new subsection (8) is introduced, allowing the Special Court to direct the Central Government to restore confiscated property to claimants with a legitimate interest who have suffered a quantifiable loss due to money laundering, provided they acted in good faith, took reasonable precautions, and were not involved in the laundering offense.
