Safeguard Measures Effective Upon Gazette Notification; Provisional Measures Start From Levy Date Under Rules 10 or 12.
The Customs Tariff (Identification and Assessment of Safeguard Measures) Rules, 1997, specify that safeguard measures imposed under rules 10 or 12 become effective upon the publication of the notification in the Official Gazette. If a provisional measure is in place and the Director General finds that increased imports have caused or threaten to cause serious injury to the domestic industry, the notification must state that the safeguard measure is effective from the date the provisional measure was levied. The term 'measure' was substituted for 'duty' effective February 2, 2021, as per Notification No. 12/2021-Customs (N.T.).
