Immunity from penalty and prosecution follows when the designated authority approves the declaration and issues written reasons. Where a declaration is made under the Company Law Settlement (Jammu & Kashmir) Scheme, 2003, the designated authority must consider the declaration and, if satisfied, issue a written order granting immunity from penalty and prosecution and stating the reasons for granting that immunity.
