Companies Must Send Resolution Notices via Registered Post and Publish in Newspapers per 2001 Rules Amendment
The Companies (Passing of the Resolution by Postal Ballot) Rules, 2001, specify the method for sending notices regarding resolutions. A company must send notices either by Registered Post Acknowledgement Due or under a certificate of posting. Additionally, the company must publish an advertisement in a leading English newspaper and a vernacular newspaper circulating in the state where the company's registered office is located, indicating that the ballot papers have been dispatched. These provisions were inserted by the amendment effective from October 11, 2001.
