Margin of dumping to be based on exporter or producer records, or facts available, affecting anti-dumping duty procedure.

The amendment limits section 9A to articles exported by an exporter or producer and adds sub-section (6A) requiring the margin of dumping to be determined from records of normal value and export price maintained by that exporter or producer, or otherwise on the facts available; it also applies, with retrospective effect, the procedural and enforcement provisions of the Customs Act, 1962 to duties chargeable under section 9A.
